Kilyn Lewis was shot dead by a Colorado police officer named Michael Dieck despite the fact that Lewis was completely unarmed and posed no threat. BOSSIP previously reported on the fatal shooting back in June—today, we have an update on the case courtesy of ABCNews.

According to District Attorney John Kellner, Dieck will not face criminal charges. Kellner wrote a 20-page letter detailing a laundry list of excuses as to why it was ok for Lewis to be killed.
Kellner said Lewis showed his left hand but put his right hand in his right rear pocket, out of the view of officers. Lewis than raised his right hand holding an object, later identified as the cellphone, and Dieck fired one shot, he said.
The Lewis family said that they are “deeply disappointed and outraged” by Kellner’s refusal to hold Dieck accountable for their loved one’s death. They took to social media to post a message that says, in part:
“This decision is not only a failure of justice but a message that the life of an unarmed Black man like Kilyn means nothing to the very system that is supposed to protect us”
This is not the end of this case as Kilyn’s family is not going to stop fighting to see that justice is served appropriately.
